Hayneedle, Inc. and our branded stores ("Hayneedle", "we", "us" or "our") provide this Privacy Policy to inform
you ("your" or collectively, our "Users") of our policies and procedures regarding the collection, use and
disclosure of information we receive from users of Hayneedle.com, its affiliated websites, and our mobile app
(collectively, the “Service”). When you use the Service, you consent to our collection, use, disclosure and
protection of information about you as described in this Privacy Policy. IF YOU DO NOT

POLICY, PLEASE DO NOT USE THE SERVICE.
Your privacy is important to us, as is your ability to choose how you are marketed to, including how information
is used to market to you. If you would like to learn more about your marketing choices, including about online

i. the information that we collect and how we collect it
We collect a variety of information from you through this Service, including when you browse our Service and
make purchases from us. We have divided this information into three categories: information that you provide,
information that we passively collect, and information that we collect from third parties or publicly available
sources. In this Privacy Policy we refer to all of this information, collectively, as the "Information."
The categories of personal information that we collect are listed below. Not all categories will be collected
about every customer:
- Personal identifiers, such as name and address
- Device and online identifiers and related information, such as telephone number and email address
- Internet, application, and network activity, such as cookie IDs and browser visits

How We Collect Information
We collect information from you in a variety of ways. It may be:
- Provided directly by you or a member of your household
- Collected from a device associated with you or your household
- Collected from an external third-party source
- Collected from another company within our family of companies
A. Information Provided Directly by Your or a Member of Your Household
When you create an account with us, make a purchase on the Service, supply information to us regarding your
personal preferences (either directly or through third-party sites that you have authorized to supply such
information to us), or interact with us in any other way (for instance, to participate in a sweepstakes or other
service or promotion we offer), we may request and you may provide Information about yourself – for instance,
Information that identifies you or provides us a way to contact you. This may include your name, email address,
mailing address, and phone number (which is sometimes referred to as “Personal Information”). We may sometimes
enhance this Information with third party information about you, which may (for instance) help us provide you
with better features and offers based on your demographic or interest information. This Information, and similar
information that you provide, may include the following:
- Account Information. When you register for an account with us, we will collect your name, email address, and
password
- Purchase Information. When you make a purchase on the Service, we collect all Information related to your
purchase. This includes your credit card number and other payment information, as well as all Information
related to your Service activity (for instance, what pages you view).
- Other Information You Provide. We will likely receive other Information you may provide to us, such as to
set up a gift registry or shopping list, receive free services, respond to surveys, enter a sweepstakes or
contest, or communicate with us.
B. Information Collected from a Device Associated with You or Your Household
In addition to the Information you provide to us directly, we may automatically collect information about your
use of the Service as follows:
- Web Log Data. When you use our websites (including this website and any other on which this Privacy Policy
is
posted), we may passively collect and analyze information such as your IP address, browser types, browser
language, operating system, the state or country from which you accessed the Service, software and hardware
attributes (including device IDs) referring and exit pages and URLs, platform type, files you download,
domain
names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular
pages or
whether you have clicked ads or content, the terms you use in searches on our Services, the date and time
you
used the Service and upload or post content, error logs, and other similar information. We or third parties
we
work with may also associate a unique identifier or "UID" with your browser, such as through a "cookie." To

to
learn how they may be used for interest-based advertising, see Section D.
- Mobile Data. If you access our Service through a mobile application that we offer, we (and our service
providers) may collect your mobile device information, your IP address, your device identifiers including an
iOS
IDFA or an Android Ad ID, and precise location information. We and third parties that we work with may use
this
location information to provide customized location-based services, advertising, personalized content,
promotional offers and other information that may be of interest to you. To learn how to opt out of this
type of
advertising, see Section V, titled "Your Ad Choices" below).
- Cookies, Mobile Ad IDs and Other Technologies. We and our third-party service providers may use cookies,
clear
GIFs, pixel tags, beacons, and other technologies that help us better understand user behavior, personalize
preferences, perform research and analytics, track your shopping cart and order history, deliver tailored
advertising, and improve the products and services we provide. We or our third-party service providers also
may
use certain of these technologies in emails to help us track email response rates, identify when our emails
are
viewed, and track whether our emails are forwarded.
- Cookies and Pixels. Cookies are files that websites send to your computer or other Internet-connected device
to
uniquely identify your browser or to store information or settings on your device. We use them to uniquely
recognize your browser when you visit our websites. Cookies also allow us and third parties to provide you
with
a better and more personalized shopping experience and to make you aware of our products and promotions that
may
be of interest to you. Our Service may use HTTP cookies, HTML5 cookies and other types of local storage
(such as
browser-based or plugin-based local storage). Most web browsers automatically accept cookies, but your
browser
may allow you to modify your browser settings to decline certain cookies if you prefer. If you disable
cookies,
you may not be able to use all of the features and functionality of this Service. To control which Web
servers
collect Information by automated means, we may place tags on our Web pages called "Web beacons," which are

files that link Web pages to particular Web servers and their cookies. We also may send instructions to your
device using JavaScript or other computer languages to gather the sorts of Information described above and

details your interactions with the Service.
- Mobile Data Collection and SDKs: If you download our mobile application, we will collect, and may allow
third
parties to collect (including through mobile "SDKs") information about your mobile device such as mobile
identifiers (e.g., IDFAs and Android Advertising IDs), your IP address, and information connected to how
your
device interacts with our Service and those using our Service. An SDK is a bit of computer code that app
developers can include in their apps to enable ads to be shown, data to be collected, and related services
to be
implemented. If you’d like to opt-out from having ads tailored to you in this way on your mobile device,
please
follow the instructions in the "Your Ad Choices" section below. We may also collect (and connect to your
mobile
identifier or other Information) precise location information, such as the latitude/longitude coordinates of
your device.
- Web Analytics. We may use third-party Web analytics services on our Service, such as those of Google
Analytics.
These service providers use the technology described above to help us analyze how users use the Service. The
Information collected by the technology (including your IP address) will be disclosed to or collected
directly
by these service providers, who use the information to evaluate your use of the Service. Please see Section
V,
titled "Your Ad
Choices" to learn how you can opt out of Google Analytics.
- Third Party Ad Targeting. We sometimes use the above technologies for interest-based advertising, which may
be
based on your device or browser’s signals received across websites or applications, and over time. Please
see
Section i.D., titled "Interest-Based, Cross-Device and Cross-Channel Advertising and Retargeting" to learn
how
you can opt out of these marketing methods and technologies.
Please note: You do not need to log in or provide Information in order to visit our website. However, if you
choose not to provide certain Information, you may not be able to register with us or take advantage of some or
all of our Service features and offerings. Providing us with Information may allow you to receive, among other
things, streamlined service, special discounts, faster checkout, order history information, and, if available,
other products, information, and/or services you may request.
C. Information Collected from an External Third-Party Source
We may collect Information about you or others through our affiliates or through non-affiliated third parties.
For instance, you may be able to access the Service through a third-party account such as Facebook. If you do
that, you generally give us access to certain Information in your third-party account profile. This may include
your public profile, name, user IDs, gender, profile picture, list of friends, location, date of birth, email
address, photos, videos, people you follow and/or who follow you, your work and education history, hometown,
current city, and/or your posts, "likes" or other third-party account content.
Facebook and other social networking services have their own policies concerning the collection, use, sharing,
and protection of your information. Hayneedle has no control over how any third-party site uses or discloses the
information they collect about you.
We may also collect Information about you or others through non-affiliated third parties, and may combine
Information you provide to us with information from public and other reputable sources, including, for example,
updated contact information and demographic data.
D. Information Collected from Another Company Within Our Family of Companies
We may collect your personal information from another organization within our corporate family of companies,
such as Walmart and Sam's Club.
E. Interest-Based, Cross-Device and Cross-Channel Advertising and Retargeting
We use advertising technologies that deliver relevant content and advertising (including ads for Hayneedle) on
the Service and on other websites you visit and other applications you use. These ads may be based on various
factors such as the content of the page you are visiting, your location, information you enter such as your age
and gender, your searches, demographic data, user-generated content, and other information we collect from you.
These ads also may be based on your activity over time and across other websites and online services and may be
tailored to your interests.
We may use third parties (e.g., ad networks and ad servers such as Google Analytics, DoubleClick and others) to
help deliver these tailored advertising on other websites and in mobile applications. These third parties may
place cookies or other tracking technologies on your computer, mobile phone, or other device to collect
information about your use of the Service as discussed above and may access these cookies or other tracking
technologies on your computer, mobile phone, or other device you use to access the Service in order to serve
these tailored advertisements. Some of these third parties may associate cookies with de-identified or
pseudonymous data derived
from registration data or "personal" information (such as a "hashed" non-human readable email value), and
associated with your interests, transactions or demographics in order to better target ads to you, whether
through display, email, or direct mail channels.
In addition, we may work with third parties to locate the same unique users across multiple browsers or devices
(such as smartphones, tablets, or computer), or work with providers that do this, in order to better tailor
content and features and provide you with a seamless experience across devices. For instance, we might work with
an ad platform to locate our web-based customers when they are on mobile applications (or vice versa). These
third parties may work with information similar to the information we’ve described above, including mobile ad
IDs, cookies, and IP addresses.
The third party providers that use the technologies we’ve described above often provide a way to opt out of this
type of "interested-based" advertising. Please see Section V, titled "Your Ad Choices" to
learn more about this
type of advertising and how to opt out.
We may use third-party service providers for mobile application analytics. Each operating system, iOS for Apple
phones, Android for Android devices and Windows for Microsoft devices provides its own instructions on how to
prevent the delivery of tailored in-application advertisements. We do not control how the applicable platform
operator allows you to control receiving personalized in-application advertisements; thus, you should contact
the platform provider for further details on opting out of tailored in-application advertisements. You may
review the support materials and/or the device settings for the respective operating systems to opt-out of
tailored in-app advertisements. Please see Section V, titled "Your Ad Choices" to
learn how you can obtain more
information about how you can opt out of some interest-based advertising on your mobile device.
F. Do-Not-Track Signals and Similar Mechanisms
We are committed to providing you with meaningful choices about the information collected on our Service for
third-party purposes. However, we do not recognize or respond to browser-initiated Do Not Track signals, as the
Internet industry is currently still working on Do Not Track standards, implementations, and solutions.
ii. e-mails we send
If you place an order, create an account with us, or otherwise provide us your e-mail address, we may use that
e-mail address to confirm your order, confirm the creation of an account, or to notify you of important
information or changes to your account or our policies and practices. In addition, we (or one of our affiliated
stores/websites) may send you information about special offers, new products and services, system changes, and
other information we think may be of interest to you. We own multiple brands/stores, and if you sign up with one
brand/store, you are automatically subscribed to all the others and may receive emails from any of our brands.
If you do not wish to receive these e-mails, you may "opt-out" or "unsubscribe" from these e-mails by following
the instructions contained in the e-mail.
iii. how we use your information
We may use your Information and/or combine any or all elements of your Information for a number of purposes,
including:
- To fulfill your order or requests for services and provide customer service
- To create and maintain your account
- To conduct auditing and monitoring of transactions and engagement
- To conduct marketing, personalization, and third-party advertising
- To protect the security and integrity of our websites, mobile services and our business, and help
prevent fraud
- To update our operational and technical functionality
- To conduct business analysis, such as analytics, projections, identifying areas for operational
improvement
- To conduct research and development
- To fulfill our legal function or obligations
To provide you with better or more relevant offers, including through co-marketing and other business partners
we may share your Information with, and including for interest-based advertising purposes. (See the below
Section titled "How We
Share Information" for additional information about how we share Information and with
whom.)
iv. how we share the information
All of the categories of personal information that we collect have been shared with other companies, including
those within our corporate family, for a business purpose. We may share the Information we collect or receive
from you in a variety of circumstances. For instance:
- Corporate Family of Companies. Hayneedle is part of the Walmart Inc. family of companies. We may share your
personal information with other brands and businesses within the Walmart corporate family. When we do, the
information will be used in ways that are consistent with this Policy.
- Service Providers. We may share your Information with service providers, contractors and other companies
to fulfill your orders, operate our business, guard against fraud and other wrongdoing, communicate with
and market to you, enhance our Information and make available the Service. For instance, we may share
certain of the Information we collect or receive with other companies that help us with billing and
payment, marketing, advertising and email marketing, data enhancement (e.g., to provide more relevant
offers to you), website hosting, technology and customer support, web and marketing analytics,
anti-fraud or security operations, and other operational, marketing or business support.
- App Store Providers. We may provide your identity and mobile device identifier to third-party app store
providers (for example, the Apple App Store) to allow you to download our mobile apps.
- Third Party Products and Services. We may share certain Information with other select companies whose
resources, products, and services you may find useful. These companies may contact you in order to
provide you with information about these products and services. Sometimes, we may share Information with
other companies in "co-marketing" efforts – for instance, if we are working with another brand to
provide joint or jointly branded offers.
- Response to Offers. If you sign up for a service or respond to an offer (for instance, a contest offer),
we may share the Information you submit with other providers or companies referenced in that offer or
service.
- Business Transfers. Information may be transferred or disclosed as part of any merger, acquisition, sale
of some or all of our assets or transition of service to another provider, including for due diligence
regarding such a transaction. In the unlikely event of an insolvency, bankruptcy or receivership,
Information also may be transferred as a business asset.
- Protection of Hayneedle and Others. We may access, monitor, use or disclose your Information or
communications to do things like: (i) comply with the law or respond in good faith to requests from law
enforcement or government entities, or other legal process; (ii) protect the rights or property of
ourselves, our agents, our customers, and others, including to enforce our agreements, policies, and
terms of use; (iii) investigate behavior that is potentially illegal or fraudulent, or is in violation
of our posted Terms of Use, and (iv) respond to emergencies.
- Online Advertising and Targeted Ads. As described in other parts of this Privacy Policy, we or ad
platforms we work with may use cookies, IP addresses and similar passively collected information to
target ads to you on this Service, other websites, or through other channels (e.g., emails, direct mail,
mobile applications), and to measure the effectiveness of this marketing. This process often involves
cookies or similar technologies, which may be associated with other information about you, e.g., your
interests, demographics or transactions. For instance, if you live in a warm climate and have bought or
viewed particular styles of outdoor furniture, you may receive ads or discount offers for those styles.
We (or our platform partners) may track this information across the different devices you use to access
the Service (e.g., smartphones, tablets, browsers, etc.), and use the Information to associate unique
users across those devices.
- Hashed Personal Information. We may work with service providers who, to enhance consumer privacy, use a
non-human readable “hashed” version of Information such as an email address when sending advertising
offers by email or display advertising (which may be linked to a cookie as described above). You can opt
out of this advertising as described in Section V, titled "Your Ad Choices"
- To Publicize Contests and Sweepstakes. We may publicly disclose the name, city, and state of the contest
and sweepstakes winners.
- Otherwise with Your Consent or at Your Direction. In addition to the sharing described in this Policy,
we may share information about you with third parties whenever you consent to or direct such sharing.
- Aggregated or De-Identified Information. We continually strive to make customer shopping experiences more
relevant and with less friction and may offer related services and insights to its suppliers and others. As
a result, we may share with others insights that combine information from many customers in ways that do not
directly identify you. For example, we may combine your shopping history with that of other customers to
deliver generalized insights to our suppliers. These insights do not identify individual customers. This
information helps our suppliers provide products and services relevant to our customers. We may receive
payment for these insights.
- To deliver information about products and services that may be of interest to you, we may share information
with other companies, such as publishers, advertisers and measurement analytics providers. For example, we
may share device-related data (such as device identifier, type of device, IP address, cookies and other
information associated with your browsing and app usage) and individual preferences and characteristics
(such as insights and inferences related to shopping patterns and behaviors). This information does not
identify you directly, but is necessary to personalize the advertisements you receive. We do not receive
payment for this information.

We think it is important that our customers have the opportunity to control how information about them is used
and how they are marketed to. We therefore provide the following choices to you:

- If you would like to unsubscribe from email marketing about Hayneedle, please follow the instructions
contained in marketing e-mails that we sent you. You may not opt out of “transactional” emails, or other
emails that are important to your use of the Service (such as regarding billing, delivery, or our terms
of service).
- If you do not want us to share your contact information with third parties for marketing purposes (i.e.,
purposes unrelated to Hayneedle), please contact us at 1-888-880-4884 or privacy@hayneedle.com. We will
then, on a going forward basis, suppress this type of information sharing.
- To opt out of Google Analytics for display advertising or customize Google display network ads, you can

- You can opt out of receiving interest-based ads from many of the third parties who serve or facilitate
these ads (and you may learn more about interest-based advertising) by visiting the opt-out pages on the

if you opt out in this way you will not stop receiving
ads; rather, the ads you receive may be less relevant to you, because they are less likely to be
targeted to your likely interests. (They may, for instance, simply be based on the page you are
visiting.) You can opt-out of receiving interest-based mobile ads, including “cross-app” advertising, by
opting out of interest-based advertising through your iOS or Android settings.
vi. security of your personal information
Hayneedle is committed to online data security, and for that reason we take technical and organizational
measures to protect your data against accidental or unlawful destruction or accidental loss, alteration,
unauthorized disclosure or access. However, no method of transmission over the Internet or via mobile
device, or method of electronic storage, is absolutely secure. Therefore, while we strive to protect your
information, we cannot guarantee its absolute security.
Your account is protected by a password. If you access your account via a social login, you may have
additional or different sign-on protection through that third party (e.g., Facebook, Pinterest, etc.). You
are responsible for preventing unauthorized access to your account and Information through your computer or
other devices. Do not share your password with anyone and do limit access to your computer or other devices
by signing off after you have finished accessing your account.

Our Service may contain links to other sites. Hayneedle is not responsible or liable for the content or
privacy policies of these third-party websites. The collection, use, and disclosure of your personal and
other information will be subject to the privacy policies of the third party websites or services, and not
this Policy. You should read the privacy and security policies of these third-parties. The inclusion of any
link does not imply our endorsement of the external site company, its website or websites, or the products
or services it promotes or sells.
viii. children's privacy
Our Service is not intended for use by children under the age of 13, and we do not knowingly collect
personal information from children under the age of 13. If you are the parent or guardian of a child under
13 who has provided her or his information to us, please contact us through one of the means listed in
Section XIII below, and we will seek to remove that information.
ix. how to access or update your information
If you would like to update or modify your Personal Information, or disable your account to prevent future
purchases through that account, you may do that through your online account settings.
x. California privacy rights
A. California Consumer Privacy Act:
If you are a California resident, you can make certain requests regarding your personal information. We will
fulfill each of these requests per the requirements of California law.
- You can request access to a copy of the personal information we have about you, including a list of
categories of your
personal information that we have sold and a list of categories of your personal information that we
have shared with another company for a business purpose.
- You can request that we delete your personal information.
- You can request that we stop selling your personal information.

- Delete My Personal Information: You have the right to ask that we delete your personal information.
Once we receive a request, we will delete the personal information (to the extent required by law)
we hold about you as of the date of your request from our records and direct any service providers
to do the same. In some cases, deletion may be accomplished through de-identification of the
information. Choosing to delete your personal information may impact your ability to use our websites and
online features, and limit your use of functions that require your personal information.
- Stop Selling My Personal Information: We share personal information within our Walmart family of companies
and with certain third parties, which may be considered a “sale” under California law even if we don’t
receive money in exchange for the information. For purposes of California law, we may share with these
parties all categories of personal information, except for government identifiers. We do not knowingly sell
the personal information of minors under 16 years of age. If you are a California resident, you have a right
to opt-out of the sale of your personal information. To do so, click “Do Not Sell My Personal Information”

Verifying Your Identity for Requests to Access or Delete Personal Information. We take the privacy of your
personal information seriously and want to ensure that we provide only you or your authorized agent with your
personal information. The CCPA also requires that we verify the identity of each person who makes a request to
know what personal information we have about you or to delete the personal information we have about you.

How do you verify my identity?
We may verify your identity in a few different ways. We’ve partnered with a third party identification
service to help us verify your identity and prevent fraudulent requests. When you make your request, you will be
asked to answer a few questions about yourself to help us validate your identity. If you have an online account,
we may ask you to log into your account and complete a one-time passcode validation.
In some instances, we may ask you to provide other documentation to verify your identity. If this happens, we
will reach out to you directly with this request.
What if you can’t verify my identity?
If we can’t verify your identity, we will not be able to process your request to know what personal
information we have about you or to delete the personal information we have about you. If we are unable to
verify your identity with a high degree of certainty, we will only be able to provide a report with

How to Submit a Request Using an Authorized Agent. An authorized agent is a person or business who has
authorization to request to know what personal information we have about you, to delete the personal information

If you submit a request on our website, you will be asked to upload this documentation when you submit your
request. If you submit your request over the phone, you will be asked to email your forms to
consumerprivacy@wal-mart.com. Please note, you will have 10 business days to provide all required documentation.
